This website at www.tobyai.io is operated by Stelliot Investments Pty Ltd (ABN 81 127 096 851), trading as TobyAI (we, us). By using the site you agree to these terms. The portal at app.tobyai.io, the API and every TobyAI tool are governed by the separate TobyAI Terms of Use, which you accept when you create an account.
Information, not advice
The site describes what the product does today and shows worked examples generated from published sources. Everything on it is general information. It is not financial, legal, tax, accounting or employment advice, is not a tax agent or BAS service, and is not a ruling or position of any regulator. An example page shows how a published figure applies to the stated inputs on the stated date; it does not tell you what applies to you. Check any figure against its cited source and take advice from a registered agent or other qualified professional before acting. Responsibility for your compliance position stays with you.
Statements about features, timing and pricing are indicative and may change. Nothing on the site is a binding offer; a contract for the product forms only under the TobyAI Terms of Use.
Our content and your use of it
The site, its text, worked examples, design, code and the names and marks TobyAI, Toby and Determine are our property or that of our licensors. Legislation and publisher material quoted on the site remains subject to its publisher's licence, which is cited beside it. You may read the site and share a link to a page. You may not copy, scrape, crawl, harvest or systematically extract the site or its pages, reproduce them elsewhere, use them to build or train a product, dataset or machine learning model, remove a citation or date from an example, or present our content as your own or as a regulator's, without our written permission.
A breach of this section may cause us harm that damages alone would not remedy. We may seek an injunction and any other remedy the law allows, and you will pay our reasonable costs of enforcement where a court finds you in breach.

Liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing here limits them. Otherwise, to the extent the law permits, the site is provided as is; we do not warrant that it is complete, current, accurate or uninterrupted, and neither we nor our directors, officers, employees or contractors are liable for any loss arising from use of the site or reliance on anything on it, whether in contract, tort (including negligence) or otherwise. The site is provided by the company named above alone, and no director, officer or employee has any personal liability to you in connection with it.
General
We may change the site and these terms at any time by posting the new version with its date. These terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of its courts.
